Terms & Conditions

 

Orders

  1. These terms and conditions cancel all previous terms and conditions.
  2. All orders are accepted notwithstanding crop failures and shortages howsoever Caused.
  3. Customers are welcome to reserve stock. All orders are taken as a firm sale.
  4. Cancellation of advance or reserve orders will be subject to a 30% cancellation fee.
  5. Orders taken for items specifically bought in are non-returnable or refundable.
  6. Credit notes are valid for 6 months from the date of issue.

Prices

  1. All prices are subject to the addition of VAT.
  2. We reserve the right to alter prices without prior notice. Unless specifically agreed otherwise.
  3. All prices quoted either verbally or in writing are for supply ex-nursery. Delivery costs are additional, please ask for details of delivery charges.
  4. You are welcome to collect your order from the nursery, subject to giving 2 working days’ notice.
  5. Unless otherwise stated in writing, quotations remain valid for 30 days. All goods are offered subject to remaining available at time of order.
  6. Trade prices are for the use of the registered trade customer, and we ask that this information is kept secure. Customers of trade customers will not be able to use approved trade accounts.

 

Payment

  1. Payment shall be made at the time of order unless an approved credit account has been opened.
  2. Payment is due on all approved credit accounts net 14 days from the date of invoice.
  3. Interest of 8% per month will be charged on all overdue accounts. Any expenses incurred in the collection of overdue accounts will be charged to the customer’s account.
  4. Payment will only be accepted from registered trade customers; we cannot accept payment from your clients.

 

Acceptance Damage and Complaints

  1. The buyer shall be deemed to have accepted the goods upon delivery.
  2. All goods must be inspected on delivery/collection and any damages or shortages notified at this time.
  3. Due to plant health reasons, once plants have left the nursery, we cannot accept stock back on site as this may endanger the health of the stock on the nursery.
  4. Stock is checked for pests and disease regularly and upon order picking, to the best of our knowledge stock is delivered in good health, Van Arnhem accepts no responsibility for subsequent infection, symptoms or any issues occurring from the stock after delivery/collection.

 

Warranty

Whilst the company takes every care to supply products of the highest quality and trueness to name. No warranty expressed or implied is given as to description, productiveness or any other matter, the company cannot be held responsible for failures.

Trading Hours

The nursery is open from 8.30am to 5.00pm Monday to Friday for trade customers. Public open days are held each Friday from 10am to 4pm

Title of Goods

  1. Risk shall pass from the seller (VAN) to the buyer (the person who buys or agreed to by the goods from the seller) on receipt of delivery.
  2. Property of the goods shall not pass from the seller to the buyer until the buyer has paid in full the price plus VAT and no other sums whatever shall be due from the buyer to the seller.
  3. Until such time as property of the goods passes from the seller to the buyer the buyer upon request will deliver the goods which have not ceased to be in existence, sold or used to the seller. If the buyer fails to this the seller may enter upon any premises owned, occupied, or controlled by the buyer where the goods are situated and repossess the goods.
  4. In the event that a receiver for whatever reason is appointed or in the event that the buyer enters into any arrangement with its creditors or passes any resolution to wind up its affairs the buyer shall inform the seller forthwith and deliver up to the seller the goods. If the buyer fails to do so the seller may enter upon any premises owned occupied or controlled by the buyer where the goods are situated and repossess the goods.

 

The placement of an order constitutes acceptance of these terms and conditions.
